Agreement to terms
If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to that entity.
If you do not agree to these Terms, do not access or use the Service. Your continued use after we post changes constitutes acceptance of the updated Terms, as described in General.
The Service
CallAid provides software for businesses to capture missed calls, automate SMS follow-up, operate AI voice assistants, sync leads to a dashboard, and manage related telephony and billing workflows. Features vary by plan and configuration.
We may offer beta, preview, or experimental features. Those features are provided as-is, may change or be withdrawn at any time, and may be subject to additional terms presented at signup or in-product.
Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining accurate account information and safeguarding login credentials. Notify us promptly of any unauthorized access to your account.
Workspace owners may invite team members and assign roles. You are responsible for actions taken under your account and for ensuring invited users comply with these Terms.
Customer responsibilities
As a business customer using CallAid, you agree to:
- Comply with applicable laws governing telemarketing, electronic communications, call recording, data protection, and industry-specific rules (including healthcare, financial, or other regulated sectors where they apply to you);
- Provide appropriate privacy notices and obtain required consents from your callers, leads, and customers;
- Configure call forwarding, SMS opt-out handling, and assistant scripts in a truthful and non-deceptive manner;
- Use phone numbers and messaging only where you have the right to do so and in accordance with carrier and platform policies;
- Review AI-generated summaries and transcripts before relying on them for operational or compliance decisions.
CallAid provides tools; you remain responsible for how you deploy them in your business and for your interactions with end customers.
Acceptable use
You may not use the Service to:
- Violate law or infringe the rights of others;
- Send spam, unlawful robocalls, or unsolicited messages without proper consent;
- Harass, threaten, defraud, or impersonate any person or entity;
- Distribute malware, probe systems, or attempt unauthorized access;
- Reverse engineer or circumvent technical limits except where permitted by law;
- Resell or sublicense the Service without our written permission;
- Use the Service in a manner that materially degrades infrastructure or other customers' experience.
We may investigate suspected violations and cooperate with law enforcement. We may suspend or terminate access for conduct that we reasonably believe violates these Terms or creates risk to CallAid, our providers, or third parties.
Plans, trials, and billing
Paid plans, usage allowances, overage rates, and trial length are described on our pricing pages and in your workspace at signup or upgrade. Trials may be offered without a payment method; when a trial ends, continued access to paid features requires an active subscription unless otherwise stated.
- Subscriptions renew automatically at the interval shown in your plan (for example, monthly or annually) until cancelled.
- Usage and overages may be measured against telephony, AI, SMS, and related metered features. Overage charges are billed according to your plan settings and in-product billing disclosures.
- Payment processing is handled by Stripe or another designated processor. You authorize us and our processor to charge applicable fees, taxes, and overages to your payment method on file.
- Failed payments may result in suspension after reasonable notice. You remain responsible for amounts incurred before suspension.
- Price changes take effect on renewal or with notice where required. If you do not agree, you may cancel before the change applies.
Except where required by law, fees are non-refundable once a billing period has started. If you believe a charge is incorrect, contact support@callaid.ai within 30 days of the invoice date.
Customer data
You retain ownership of content you submit to the Service, including business profiles, prompts, call and message data, and lead records ("Customer Data"). You grant CallAid a worldwide, non-exclusive license to host, process, transmit, and display Customer Data solely to provide and improve the Service, as described in our Privacy Policy.
You represent that you have all rights necessary to provide Customer Data and that our processing on your instructions does not violate third-party rights or applicable law.
Upon termination, you may export Customer Data where the product provides export tools. We may delete Customer Data after a reasonable retention period, subject to legal holds and backup cycles described in the Privacy Policy.
Intellectual property
CallAid and its licensors own the Service, software, documentation, branding, and all related intellectual property, excluding Customer Data. No rights are granted except as expressly set out in these Terms.
If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.
Confidentiality
Each party may receive non-public information from the other. The receiving party will use reasonable care to protect confidential information and use it only for purposes related to the Service. Confidentiality obligations do not apply to information that is public, independently developed, or rightfully received from a third party without duty of confidence.
Third-party services
The Service integrates with third-party providers such as telephony carriers, calendar platforms, payment processors, and AI vendors. Your use of those services may be subject to separate terms. CallAid is not responsible for third-party products, outages, or policy changes outside our control.
Availability and changes
We strive for high availability but do not guarantee uninterrupted or error-free operation. Maintenance, carrier issues, and force majeure events may affect the Service.
We may modify features, deprecate functionality, or discontinue parts of the Service with reasonable notice when practicable. Material reductions to paid features during an active paid term will be handled in line with your plan terms or applicable law.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLAID DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT AI-GENERATED OUTPUT, TRANSCRIPTS, OR SUMMARIES WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE. YOU ARE RESPONSIBLE FOR REVIEWING OUTPUT BEFORE ACTING ON IT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLAID AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO CALLAID FOR THE SERVICE IN THAT 12-MONTH PERIOD OR (B) ONE HUNDRED POUNDS STERLING (£100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW (INCLUDING DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FRAUD).
Indemnification
You will defend, indemnify, and hold harmless CallAid and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your Customer Data, your use of the Service, your violation of these Terms, or your violation of applicable law or third-party rights.
Suspension and termination
You may cancel your subscription through billing settings or by contacting support. Cancellation stops future renewals; access may continue until the end of the current paid period unless otherwise stated.
We may suspend or terminate your access immediately if you materially breach these Terms, fail to pay amounts due, or create security or legal risk. Upon termination, your right to use the Service ends, but sections that by nature should survive (including payment obligations, disclaimers, liability limits, indemnity, and governing law) will survive.
Governing law and disputes
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. The courts of England and Wales have exclusive jurisdiction over disputes arising from these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction.
If you are a consumer in a jurisdiction that grants mandatory local rights, nothing in these Terms limits rights that cannot be waived by contract.
General
- Entire agreement. These Terms, together with the Privacy Policy and plan-specific order terms presented at checkout, form the entire agreement regarding the Service.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a corporate transaction.
- Severability. If any provision is unenforceable, the remainder stays in effect.
- No waiver. Failure to enforce a provision is not a waiver of future enforcement.
- Changes. We may update these Terms by posting a revised version and updating the "Last updated" date. Material changes will be communicated where required. If you object to changes, you must stop using the Service before they take effect.
